LaMB CONTEST OFFICIAL RULES
NO PURCHASE NECESSARY. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. CONTEST IS VOID WHERE PROHIBITED BY LAW.
1. Eligibility. K2 NETWORK, INC. ("SPONSOR") IS THE SPONSOR OF THIS CONTEST ("CONTEST"). THIS CONTEST IS OPEN ONLY TO INDIVIDUALS WHO ARE A LEAST 18 YEARS OF AGE AND ARE REGISTERED GAMERSFIRST MEMBERS AT THE TIME OF ENTRY (THE "ELIGIBLE PARTICIPANTS"). IF YOU DO NOT MEET THE FOREGOING CRITERIA, YOU ARE NOT ELIGIBLE TO ENTER OR WIN A PRIZE. Directors, officers and employees of Sponsor and any of its affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, and immediate families and persons domiciled with each are not eligible to enter or win any prizes. All applicable federal, state, provincial and local laws and regulations apply. Void where prohibited or restricted by law. This promotion may not be available in every country. If this promotion is prohibited or restricted by law in your country of residence, you will not be able to enter or receive any prize.
2. Disclaimer. Except in the event of willful or grossly negligent conduct, Sponsor, Animax (a Sony Pictures Entertainment company), and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any Contest disruptions, injuries, losses or damages caused by events beyond the control of Sponsor; or (d) any printing or typographical errors in any materials associated with the Contest, for reasons beyond Sponsor's control. This limitation may not be enforceable in all jurisdictions and therefore may not apply to all Eligible Participants.
3. Contest Period. The Contest shall run for a six week period commencing on April 5th at 12:00 AM Pacific Time ("PT") (GMT -8:00) (the "Commencement Date") and ending on May 16th at 11:59 PM PT (GMT -8:00) (the "Deadline") (such six week period to be hereinafter referred to as the "Contest Period"). During the Contest Period, there will be six (6) separate weekly challenges, running one after the other, with each weekly challenge running from Sunday at 12:00 AM PT (GMT -8:00) of one week until the following Saturday at 11:59 PM PT (GMT - 8:00) (each a "Weekly Challenge"). Weekly Challenge 1 shall take place from April 5th, 2009 until April 11th, 2009, and Weekly Challenges 2 through 6 shall follow one after the other in order subsequently thereafter.
4. Entry in the Contest. During the Contest Period, Eligible Participants may enter the Contest by visiting the GamersFirst LaMB web site located at www.gamersfirst.com/lamb and entering the Contest on the web site. Please note that you must be a GamersFirst registered member to enter the Contest. If you are not a GamersFirst registered member, you must first register to become a GamersFirst member before you can enter the contest. Registration to become a GamersFirst member is free. In order to register as a GamersFirst member, you will be required to provide your name, address, phone number, date of birth (to verify eligibility only), and email address. Automated entries are prohibited, and any use of such automated devices will cause disqualification.
5. Winner Selection. There will be four (4) winners of each of the six (6) Weekly Challenges during the Contest Period, and one winner to be selected from a random drawing of all Eligible Participants to take place at the end of the Contest Period, for a total of 25 winners. To select the winners for the Weekly Challenges, at the end of each Weekly Challenge the top score leaders from each of the four games (Discovery, Encounter, Empathy, and Insurrection) during the period of such Weekly Challenge (4 winners for each Weekly Challenge) will receive a prize consisting of a LaMB poster signed by Artgerm (Stanley Lau) from Imaginary Friends Studio! The one winner for the random drawing will be selected during a random drawing of Eligible Participants to be conducted by Sponsor at the end of the Contest Period, and will receive a prize consisting of one of the posters described above, subject to eligibility. By participating, entrants agree to abide by and be bound by these Official Rules and K2 Network's decisions. Winners of each Weekly Challenge will be notified by email after such Weekly Challenge has been completed, and the winner of the random drawing will be notified by email after the drawing is completed. Prizes will be mailed by Sponsor to the winners.
Selection of winners of Weekly Challenges, the drawing and awarding of prizes will be conducted by Sponsor whose decisions on all matters relating to this Contest are final.
6. Prizes. Twenty-five (25) LaMB posters signed by Artgerm (Stanley Lau) from Imaginary Friends Studio. (ARV $25)
The announced values are the approximate retail values of the prizes and are subject to increases and decreases as per the market conditions. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER. Each Prize Winner may be required to execute an affidavit or certificate of liability release and eligibility release before award of any prize. All winners may be required to show proof of eligibility before award of any prize. Prizes returned as undeliverable, for reasons beyond the Sponsor's control, will be forfeited and may be awarded to an alternate winner. If any winner cannot be reached for any reason, or fails to respond or return the appropriate documentation within fourteen (14) days, prize will be forfeited and awarded to an alternate winner. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize in its sole discretion. Limit one prize per household or e-mail address except for the prize for the winner of the random drawing, which may be awarded to an Eligible Participant that has already won a prize for a Weekly Challenge All prizes are awarded "AS IS."
7. Decisions of Sponsor. The decision of the Sponsor is final with respect to all matters involving this Contest. Winners will be notified by e-mail (or any other appropriate method) promptly after determination by Sponsor.
8. Collection of Information. Entry into the Contest requires you to enter your email address and country of origin. By entering the Contest, you consent to Sponsor's use of this information, as well as your name, image, likeness and biographical information in connection with the Contest as well as for advertising, marketing and publicity purposes in connection with the Contest, in any and all media now or hereinafter invented, throughout the world in perpetuity. You are informed that the personal data collected in connection with the Contest will be collected by the Sponsor's servers and computer systems which are based in the USA, and such collection will therefore be subject to applicable US laws. Upon request, you will be provided with access to your personal data. You also have a right of opposition to the data collection, and to oppose the collection of such personal data under certain circumstances. You may also withdraw your personal data upon request; however you will be disqualified as a entrant in the Contest if you withdraw your personal data prior to the determination and fulfillment of the prizes.
9. General Release. By entering this contest, you forever release and waive any and all claims that you might have against K2 Network, Inc. and its subsidiaries, affiliates, successors, licensees, agents and assigns, and the officers, directors, members, shareholders and employees of the foregoing (collectively, "K2 Network") and against Animax and its subsidiaries, affiliates, successors, licensees, agents and assigns, and the officers, directors, members, shareholders and employees of Animax (collectively, "Animax Releasees") arising out of or related in any way to injuries, damages, losses, costs or expenses of any kind or nature resulting from acceptance, use or misuse of any prize or parts thereof or your participation in this contest. You further indemnify and hold harmless K2 Network and Animax Releases from and against any and all third-party claims, liabilities, costs and expenses (including attorneys' fees reasonably incurred) arising out of or related to (a) any breach or alleged breach or violation of these rules by you, (b) your acceptance, use or misuse of any prize or parts thereof, and (c) your participation in this contest.
Non-compliance with these requirements may result in disqualification, and the prizes may be forfeited and an alternate winner selected from the next top score leader in that given game. In the event that a prize or prize notification is returned as undeliverable, such prize will be forfeited and an alternate winner selected from the next top score leader in that given game. Acceptance of a prize constitutes permission to K2 Network and its representatives to use the winner's user name and/or likeness for purposes of advertising and trade without further compensation. By participating, entrant agrees to the Official Rules and judges' decisions. In the event that any dispute arises regarding the meaning or interpretation of these Official Rules, participants agree that the dispute shall be resolved by applying the laws of California and that it shall be resolved by and within the courts of Orange County, California, and you consent to the exclusive jurisdiction of, and service of process by, such Courts for the purpose of resolving any disputes, and further consent to the propriety of venue in such Courts.
K2 Network reserves the right to terminate further entry in the Contest if technical difficulties, including but not limited to infection caused by computer virus, bugs, tampering, unauthorized intervention, fraud or other technical failures, compromise the integrity or ability to continue such entry. Unless otherwise set forth herein, K2 Network's Privacy Policy located at http://www.gamersfirst.com/privacy_policy.php shall apply to this Contest; provided, however, in the event of any discrepancy or inconsistency between or among the privacy policy and these rules, these rules shall govern.
10. Winners List; Rules Request. Winners will be posted online at http://forums.gamersfirst.com/. 11. Miscellaneous. The Contest and these Official Rules will be governed, construed and interpreted under the laws of the United States. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Except where prohibited by law, Sponsor reserves the right in the event of unforeseen circumstances beyond its control to change these Official Rules at any time (in which event Sponsor will give Eligible Participants as much notice of such change as practicable and Eligible Participants may withdraw their entry by emailing Sponsor at events@gamersfirst.com), and to suspend or cancel the Contest or any Eligible Participant's participation in the Contest should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor's control affect the administration, security or proper play of the Contest or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Contest as planned. Eligible Participants who violate these Official Rules, tamper with the operation of the Contest, whose account is blocked or banned, or who engage in any conduct that is detrimental or unfair to Sponsor, the Contest or any other entrant are subject to disqualification from entry into the Contest. Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Contest. In case of dispute, entries will be declared made by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet Access Provider, on-line service provider, or other organization (e.g., business educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
